By accessing or using Calibrate ("the Service") at calibr8ed.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including teachers, school administrators, and district administrators.

You are responsible for maintaining the confidentiality of your account and all activity that occurs under it. You must notify us immediately at contact@calibr8ed.com if you suspect unauthorized access to your account.
If you are using Calibrate on behalf of a school or district, you represent that you have the authority to bind that institution to these Terms and that the institution agrees to these Terms.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
AI grades require teacher review: Calibrate generates draft grades to assist teachers. Final grading decisions must always be made by a qualified teacher. You are responsible for reviewing all AI-generated grades before recording them as official grades.

Schools and districts that require a formal Data Processing Agreement (DPA) should contact us at privacy@calibr8ed.com.
You retain ownership of your rubrics, calibration settings, and any content you create in Calibrate. By using the Service, you grant Calibrate a limited license to store and process this content solely to provide the Service to you.
Student work belongs to the student (and under FERPA, is subject to school/parent rights). Calibrate processes student submissions solely to generate grades and feedback and does not claim any ownership over student work.
The Calibrate platform, including its software, AI models, prompts, and user interface, is owned by Calibrate and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.
Important: AI-generated grades are drafts to assist teachers, not final assessments. Calibrate's AI may make errors, miss context, or score in ways that do not reflect a student's actual learning. All AI grades must be reviewed by a qualified teacher before use.
Calibrate makes no warranty that AI-generated grades will be accurate, complete, or free from bias. Specifically:
Calibrate's calibration system is designed to improve AI accuracy over time as teachers provide feedback, but does not guarantee perfect alignment with any teacher's standards.
Calibrate is currently available in an early access period. Pricing and subscription terms will be communicated before any charges are applied.
We will provide at least 30 days notice before introducing paid features or changing pricing. You will always have the option to export your data before any pricing change takes effect.
Founding members who joined during the early access period are subject to the specific terms communicated at the time of their enrollment.
You may stop using Calibrate at any time. To delete your account and all associated data, contact us at contact@calibr8ed.com. We will process deletion requests within 30 days.
We may suspend or terminate your access to Calibrate if you violate these Terms, engage in conduct that harms other users or the Service, or for any reason with 30 days notice.
Upon termination, you will have 30 days to export your data before it is deleted.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for the accuracy of AI-generated grades.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALIBRATE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CALIBRATE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
IN NO EVENT SHALL CALIBRATE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold harmless Calibrate from any claims arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights including student privacy rights.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Calibrate dashboard at least 30 days before changes take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
